Declaration of World Federal Distinction
Whereas much of the world is already divided into various continental or sub-continental federations;
Whereas in addition to continental and sub-continental federations, there are also cases of regional military blocks that divide and endanger the peace of Earth by their very existence;
Whereas the nature of the social contract within federal union is fundamentally and essentially different from the social contract or lack thereof within any confederation, alliance or treaty system;
Whereas, up to the present, there has been confusion at some levels supposing that a nation could enter the Earth Federation by any treaty, alliance or confederation;
Whereas, up to the present there has been apparent confusion at some levels that the Constitution for the Federation of Earth were a proposal for a treaty, or for a new system of treaties, alliances, blocks or confederation;
For the sake of harmony in the countries of the world,
This twelfth session of the World Parliament convening at Kolkata, in December 2010, under the authority of Article 19 of the Constitution for the Federation of Earth, hereby declares and reaffirms the principle of world federal distinction—that preliminary ratification of the Constitution for the Federation of Earth is an internal affair for both the respective state ratifying as well as for the Earth Federation. Unlike a treaty system, alliance or confederation, states within the Earth Federation have no exterior relation vis-à-vis the Earth Federation. From member states of the Earth Federation, there are no ambassadors appointed to represent the state, because there is no con-federal relation. For member states of the Earth Federation, there is no exterior relation but rather a federal relation to other states of the Earth Federation, as well as to the Earth Federation itself.
This principle recognizes states and federal relation based upon world constitutional ratification, not upon military prowess, and not upon continental federation. The Earth Federation recognizes nationhood based upon ratification, not based upon prior status in any alliance, confederation, treaty system, continental federation or sub-continental union. In keeping with this principle, the constituent states, cantons, pradesh or provinces of any continental federation (confederation or sub-continental union) may directly and preliminarily ratify the Constitution for the Federation of Earth without waiting for their respective continental federation (confederation or sub-continental union) to do so first. Preliminary ratification of the Earth Constitution does not imply or signify any alliance, confederation or treaty. Furthermore, the inclusion of any state in the Earth Federation does not terminate the powers and responsibilities that state has in relation to its respective continental federation (confederation or sub-continental union) insofar as the state’s powers and responsibilities are not in violation of world law. Only in any respect that the responsibilities are in violation of world law, the obligation to the continental federation (confederation or sub-continental union) dissolves.
With this clarification of world federal distinction, the World Parliament, acting on behalf of the people of Earth, once again welcomes the nations and people of the Earth to ratify the Earth Constitution and truly unite as the Earth Federation.
